Patients claim they developed bladder cancer from diabetes drug

A lawsuit was filed in which a man alleged that the type 2 diabetes medication Actos causes bladder cancer and the case is set to go to trial early next year in California, according to a press release issued by Bernstein Liebhard LLP, a New York-based law firm.

Hundreds of other suits claiming that the medication causes bladder cancer are still under review in a federal multidistrict litigation process, with trials beginning at the end of 2014 and lasting throughout 2015.

Texas resident Jeffrey Zurio developed bladder cancer after taking the medication for at least six years, according to Injury Lawyer News. After this period of time, the U.S. Food and Drug Administration (FDA) released a warning that Actos may put patients at risk of developing the disease.

The plaintiff stopped taking the medication several months after diagnosis and finding out the link between the medication and cancer. Zurio filed a suit against Actos manufacturer Takeda Pharmaceuticals, claiming negligence and lack of strict liability.

"The lawsuit makes reference to a three-year PROactive study that was published in 2005," the news source reported. "Over the course of the study, researchers unexpectedly found that Actos users developed bladder cancer at a much higher rate than patients taking other diabetes medications. Yet Takeda did not inform the public or the medical community of these findings."

Companies that wish to avoid these types of publicly broadcasted disputes should work to ensure that their products are safe and communicate with their consumers whenever a discrepancy is found.

By working with experienced business attorneys from Phoenix law offices, Arizona companies can ensure that dispute resolution tactics solve any problems with their customers before a lawsuit is onhand.
