Motion to merge Pradaxa lawsuits

When a business releases a new product for sale to the general public, the item most likely had to go through rigorous safety inspections to make sure it would not cause injuries to consumers. However, at times, manufacturers, whether they develop cars or prescription medication, may find that their product has become a safety concern. In such scenarios, a business owner may find himself or herself in the midst of a lawsuit and may need the help of Phoenix business lawyers.
For instance, the manufacturer of the drug Pradaxa, Boehringer Ingelheim, found itself in the midst of a number of lawsuits accusing the developer of not providing enough information on the side effects of the drug. More than 20 lawsuits have been filed against Pradaxa, which caused 542 deaths and 3,781 serious injuries in 2011, according to Injury Lawyer News.
Because of the expanding number of lawsuits filed against this manufacturer, a motion was filed with the U.S. Judicial Panel on Multidistrict Litigation that asks to combine the cases brought forward against Boehringer Ingelheim. The motion seeks to merge all lawsuits into a single MDL in a district of Illinois under Judge David Herndon.
"MDL consolidation is common in drug pharmaceutical litigation, to reduce duplicative discovery and avoid inconsistent pretrial rulings from different federal courts located throughout the United States," Attorney Shezad Malik wrote in a blog for the InjuryBoard BlogNetwork. "If a Pradaxa settlement is not reached during pretrial proceedings, each individual claim would then be remanded back to the original federal district court where it was filed for a trial date."
Along with the original 21 lawsuits, it is expected that the internal bleeding side effect caused by Pradaxa could bring more than 500 additional cases against the manufacturer.
Companies in Phoenix that may have released a product producing safety concerns may need to partner with a business law attorney who has the resources to defend such a firm.
