Patent infringement and the intellectual property law encompass an aspect of business law that attorneys and companies have been battling over for centuries. Business owners will need to ensure that they do not copy or steal other's ideas, products or services in order to avoid a potential lawsuit. By speaking with business attorneys in Phoenix, companies will be able to gain the knowledge necessary to avoid such legal battles.

According to Forbes, the Julia Child Foundation has accused one advertising agency of copyright and trademark infringement. This organization has allegedly used former cookbook writer and television personality Julia Child's words and pictures without gaining the proper rights to do so.

Thermador – a provider of cooking products – and its ad agency, DGWB Advertising and communications, was planning on using this information when advertising a line of ovens and stovetops.

"Throughout her life and career, Julia Child had many opportunities for commercial advancement, including entering into commercial endorsement opportunities with companies in the food and culinary industry," The Julia Child Foundation stated in its complaint against Themador and DGWB. "She could have created a lifestyle brand like Martha Stewart or Oprah Winfrey, and endorsed major corporations and product manufacturers, like Thermador and others, for large sums of money. She chose to forgo all such commercial opportunities."

The Associated Press reported that the foundation sent a letter last month to the companies that allegedly stole Child's words. Within the letter, the organization stated that they had "exclusive ownership" to all images, statements and celebrity-related information of Julia Child.

When it comes to copyright infringement, companies will need to be careful to avoid committing this error. In case a company is accused of copyright and trademark infringement – or has alleged another business did so – Phoenix business lawyers can help protect their image and ensure a company remains in good standing.
