Justin Bieber and a company that hosted one of his concerts is being sued by Stacey Betts, a mother of a Bieber fan, according to the National Post. Betts is suing the musician for more than $9 million due to his alleged responsibility in her hearing loss, which occurred after she attended his concert in 2010.
Bieber and his lawyers are fighting the charge while Betts is representing herself in court. The lawsuit was filed in Portland, Oregon and claims the singer incited the crowd to be significantly loud, with many young concert-goers allegedly screaming in Betts' ear.
The defendant's lawyers, however, claim that it is not his responsibility to silence the crowd. They also argue that the claims be dropped as there are not enough facts and evidence for her allegations.
The Washington Times reported that Betts is not likely to win the suit because she will have difficulty establishing the fact that the defendant owed her a duty to protect her hearing. Also, she is likely to fail the affirmative defense of risk assumption, as attending a rock concert is not a quiet affair.
As Justin Bieber has become more famous and well-known in recent years, he is more likely to have a strong legal team representing him in court, which tips the scale in his direction regarding the contention of the lawsuit.
Businesses in Arizona that encounter frivolous lawsuits filed by customers will need to partner with a strong legal defense team in order to protect their company from significant financial losses.
Phoenix business attorneys can help companies develop solutions to consumer complaints. In particular, arbitration and dispute resolution tactics work well at enhancing the relationships between business owners and their customers.
