Class-action lawsuit filed against Time Warner for new fee

Time Warner Cable is being sued through a class-action case due to its new $3.95 monthly lease fee for cable customers, which was initiated on October 15, according to the Times Union. Many consumers have expressed disconcert over the fee and attorney Steven Wittels of The Roth Law Firm will be representing the plaintiffs.
The lawsuits were filed in the Supreme Court of New York County and Superior Court in Bergen County in New Jersey. The plaintiffs are seeking to put an end to the monthly charge through an injunction against Time Warner.
The suit represents 15 million customers in 29 states across the country and the lawyers representing the plaintiffs claim that the new fee will bring the company to gain an additional $40 million per month, pushing their annual profits past $20 billion.
"It's a massive high-tech consumer fraud accomplished by low-tech methods," Wittels said in a statement.
The contracts the customers signed do not allow the company to assign a modem fee, said the lawyers. Time Warner also violated its policy of waiting at least 30 days before initiating this type of fee on its customers after releasing the updated pricing plan.
