Additional lawsuit filed against Cinemark in Aurora movie theater shooting

This blog has reported on the lawsuits that stemmed from the Aurora, Colorado movie theater shooting, which killed 12 people and injured 58 others. The Associated Press reported on a subsequent suit filed by a law firm that alleges gross negligence on the part of the Plano, Texas-based Cinemark. The plaintiffs claimed that the company failed to protect its consumers during the shooting.
In particular, many of the lawsuits filed after the incident cite that there were serious security issues present. Cinemark, however, alleged that it could not have predicted that such an event could occur.
James Holmes, 24, was charged with this crime but lawsuits against businesses keep piling up. Holmes is charged with first degree murder, which potentially carries the death penalty in Colorado. However, plaintiffs are alleging that Cinemark failed to ensure that its property was safe, according to Bloomberg BusinessWeek.
In particular, several suits claim that the company had noticed previous disturbances at the movie theater, which included robberies, assaults and other shootings. Marc Bern, a lawyer for the plaintiffs, spoke with the news source, saying that damages from the suit may bring millions of dollars for his clients.
"Nobody in that theater tried to do anything to mitigate those injuries," Bern told the news source.
To avoid a potential lawsuit in case a company undergoes any similar tragedy, businesses need to ensure that their facilities have significant amount of security on site. Hiring guards may not be out of the question, regardless of whether one is running a mere grocery store, local restaurant or other small to medium-sized business.
