Lawsuit regarding alleged harmful effects of gas drilling dismissed

The Associated Press reported that one lawsuit regarding the alleged harmful effects of a gas drilling company has been dismissed. A federal judge in New York ruled in favor of the Army Corps of Engineers and the Environmental Protection Agency and rejected state Attorney General Eric Schneiderman's request to accomplish a full environmental analysis. Schneiderman wanted to review the harmful effects of gas drilling in a watershed that sends water to millions of people in the state.

U.S. District Court Judge Nicholas Garaufis stated that the lawsuit came much too early and that Schneiderman has the right to file a case against this gas drilling project after the regulations of the situation have been finalized.

‘"This office will continue to review all options moving forward to ensure that the federal government meets its clear legal obligation to fully study the potential risks to New Yorkers' health, environment and public safety before allowing fracking in the Delaware River Basin," Schneiderman said in a statement.

The Delaware River Basin Commission will review whether the area is safe for high-volume hydraulic fracturing, according to the source.
