The marketing message behind every company's image needs to be considered if a business owner wishes to gain reputable recognition in their industry. Sometimes a negative or false advertisement can cause aggravation for a business. If a consumer files a lawsuit against a company due to its marketing message, a business owner can adopt the services of a business lawyer in Phoenix to protect its firm.
Recent litigation against the Tropicana orange juice manufacturers have accused the company of providing false advertisements in regards to the "natural" and "fresh from the grove" aspects of the drink. The TV commercial shows a mother reaching for the product in a grocery store and receiving a carton that was picked directly from an orchard. However, plaintiffs allege that manufacturers use preservatives, aromas, flavors and other chemicals to give the juice a longer shelf-life.
The Tampa Bay Times reports that the suit originally started in January when Angelena Lewis accused the juice company of false advertising and packaging.
The juice is developed by PepsiCo and plaintiffs allege the company's products go through a broad processing and storage regimen before sending packages to grocery stores. After the first lawsuit, 19 more were filed against the juice manufacturers.
"At issue is the lack of clarity by the Federal Trade Commission and the Food and Drug Administration, two agencies responsible for food labeling and advertising claim," the news source stated. "In this case, they failed to define 'natural' and left it to the industry to decide how it applies. If the feds say the OJ industry can use 'natural' as it sees fit, then all these lawsuits may not have much to argue."
Other organizations that have had consumer complaints or cases brought before them due to their marketing aims may need to seek the legal advice of a business attorney in Phoenix.
